Free Private License

Licensee must include the following notice in the User Product: « Portions Copyright © 1998-1999 Aandacht c.v., all rights reserved. », and do so immediately following Licensee's own copyright notice, or if Licensee does not include his own copyright notice, in places where such copyright notice is usually found with software.

Licensee itself or one of it's affiliates or associated organizations cannot obtain a free Evaluation License for using the Product with the User Product, or do so under the free Development License, but should purchase sufficient paid licenses for that purpose instead.

The User Product can be distributed to or be made available for use by third parties (called "End User"), that are not Licensee itself or one of it's affiliates or associated organizations, under the following conditions:

1. The End User is not misguided or misinformed on that he cannot use the User Product or the parts thereof that access the Product, without accepting and complying to this Agreement, or on that he is granted an Evaluation License only and has to purchase a paid license to the Product for continued use.
2. The End User is informed and fully instructed how he can purchase a paid license to the Product and how he can, in such case, replace the Evaluation Version of the Product by the Production Version of the Product for use with the User Product. Also such replacement is made easy for the targeted End User.
3. During installation or first use of the User Product, and if feasible at an earlier moment, the End User is informed that he has to read this Agreement and that he is granted an Evaluation License to the Product provided he accepts this Agreement. This is however not needed while making the User Product available for use as a Java Applet that is embedded in an HTML document on an Internet website, and for demonstration purposes only.
4. Acceptance of this Agreement by the End User, granting the End User a free Evaluation License, is brought about before first use in either of following two ways:
   1. The User Product is distributed together with the complete and unmodified original distribution package (.zip file) for the Evaluation Version of the Product or informs the End User how and where he can obtain it from Aandacht, and includes no separate parts of the Product that would allow the End User to use the Product without reading and accepting this Agreement.
      In this case Licensee has to provide End User with adequate instructions to locate the Product's original distribution package (.zip file), to read and accept the Agreement, and to install the Product.
   2. The installation procedure or first use procedure of the User Product installs the Product with or makes the Product available for use by the End User only after he has read and accepted this Agreement. The User Product may include a faithful translation of this Agreement, provided that the original Agreement itself (this document) is included with the User Product as well, and that such translation refers to the original Agreement as the only authoritative version.
      In this case the User Product as distributed to or made available to End User need not contain other parts of the Product than this Agreement and the parts needed in the User Product.

Before the end of the 30 day evaluation period, Licensee must either purchase a paid license to the Product or remove the Product from all the machines where Licensee installed it. In either case the Evaluation License is terminated. Licensee cannot obtain an Evaluation License more than once for the Product, except for a later major release of the Product, as is indicated by a change in the first (leftmost) numeric component of the Product's release number.

Licensee may make archival copies of the Product. If Licensee is a legal entity, Licensee may distribute complete, unmodified copies of the Product's distribution package (.zip file) within its association or organization. The terms of this agreement and the starting date of the free evaluation period apply to each copy Licensee so makes.

The Product may be installed on a network or client server system, accessible from multiple connected workstations or computer systems. At no time may the total number of users exceed the sum of Single User Licenses and Concurrent Licenses for which Licensee has paid a license fee.

1. The User Product adds significant and primary functionality to the Product.
2. Licensee does not document, expose or makes in any other way accessible the application programmers interface of the Product.
3. The Redistributables are unmodified, in particular, but not limiting, retain the unmodified and unobscured propriety and copyright notices of Aandacht.
4. Licensee does not permit further redistribution of the Product or parts of it by End User. However Licensee may permit distributors to further redistribute the Redistributables in conjunction with, and as part of, the User Product to End Users.
5. Licensee agrees to indemnify, hold harmless and defend Aandacht from and against any claims or lawsuits, including attorney's fees, that arise or result from the use or distribution of the User Product.
